Personal data protection
As the controller of personal data, the Attorney at Law processes personal data in accordance with legal regulations, in particular Act No.85/1996 Coll. (the Act on Advocacy) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.
Personal data processed
The Attorney at Law processes only such personal data as are necessary for the proper provision of legal services and compliance with legal obligations. Thus, the Attorney at Law collects necessary personal data of her clients, potential clients and, where applicable, third parties for the provision of legal services.
In particular, the Attorney at Law processes the following data:
a) identification data of the client and third parties,
b) descriptive data of the client and third parties.
The legal basis for the processing of personal data
The legal basis for the processing of personal data is:
a) the performance of the contract on the provision of legal services,
b) the performance of legal obligations, in particular, the obligation to identify or control the client or another person following the Act No. 253/2008 Coll, on certain measures against the legalization of proceeds of crime; in the declaration of the authenticity of the signature or keeping documentation or client file (including the minimum period of retention of documentation), or in the performance of other obligations of the attorney pursuant to Act No.85/1996 Coll., on Advocacy and related state regulations; of the formalities regarding billing for legal services and the minimum period of retention of relevant accounting/tax documents pursuant to tax laws and the Accounting Act.
Purpose of the processing of personal data
The Attorney at Law processes personal data for the purpose of providing legal services in accordance with the contract on the provision of legal services. Duration of the processing of personal data Personal data collected during the provision of legal services are retained by the Attorney at Law in accordance with the legal and statutory regulations for a period of 10 years after the termination of the provision of legal services, or for as long as necessary for the exercise or performance of the lawyer's rights, or for the exercise or performance of the rights of the lawyer's clients.
Recipients of personal data
Personal data collected in the course of providing legal services may be accessed by:
a) IT service providers,
b) providers of file management software solutions,
c) accountants and tax advisors,
d) public authorities,
e) where appropriate, in accordance with the interests of the client, third parties, in particular counterparties in the context of negotiations with them.
All data processors provide sufficient technical and organisational safeguards to ensure the security of personal data.
Client's rights
The client has the following rights under the Regulation:
a) Right of access to personal data
The client has the right to obtain information from the Attorney at Law about whether she processes their personal data and, if so, which data are processed and how they are processed.
b) Right to rectification
The client has the right to have inaccurate personal data rectified and incomplete personal data completed.
c) Right to object
The client has the right to object to the processing of personal data where such processing is carried out for the purposes of the lawyer's legitimate interests.
d) Right to erasure
The client has the right to have the personal data concerning them erased if the conditions of the Regulation are fulfilled.The personal data must be erased in particular if they are no longer necessary for the purpose for which they were collected or processed.
e) Right to portability
The client has the right to obtain the personal data they have provided to the controller in a common and machine-readable format. They may subsequently transmit this data to another controller or, if technically feasible, request that the controllers transmit it between themselves.
f) Right to restriction of processing
In the cases provided for in the Regulation, the client has the right to have the lawyer restrict the processing of their personal data.
g) Right to lodge a complaint with the Office for Personal Data Protection
The client has the right to lodge a complaint with the Office for Personal Data Protection, located at Pplk. Sochora 27, 170 00 Prague 7, phone no. 234 665 111, email: posta@uoou.cz, which is the supervisory authority in the field of personal data protection.
